These General Terms and Conditions of Sale define the rights and obligations of the parties regarding the sale of digital creations (AI-generated portraits) and their possible physical printed provided by the PictiArt platform (edited by ELEMENT SAS) to the client.
The client submits a base photograph. Our professional-grade Artificial Intelligence algorithm processes the image to integrate it into the selected photographic style.
The client views a low-resolution watermarked preview of the final result. The order is validated after payment.
Attention: AI reinterprets the original image. Some features may be slightly altered or artistically sublimated. By validating the order after preview, the client fully accepts the artistic rendering of the portrait as displayed on the screen.
The prices of our products are indicated in euros, all taxes included (TTC). Payment for purchases is made in full upon ordering by credit card via the secure Easytransac platform.
The client's attention is expressly drawn to Article L221-28 3° of the French Consumer Code:
"The right of withdrawal cannot be exercised for contracts supplying goods made to the consumer's specifications or clearly personalized (custom-made)."
All our digital portraits (HD Files) and prints (Art Paper, Canvas, Frames) are created exclusively from the photo provided by the client and are deeply individualized. Consequently, these creations cannot be reused or resold. The right of withdrawal therefore does not apply after payment validation. No refund or exchange can be claimed for "unaesthetic rendering" or "change of mind", as the free preview (watermarked) serves as the basis for accepting the final artwork.
Upon payment, the client receives a license for personal and non-commercial use of this HD file (home printing, personal social media sharing). Any commercial, advertising use, or resale of the artwork requires prior specific agreement.
Photographs uploaded for portrait generation are securely processed and are not used to train public Artificial Intelligence databases. Unless explicitly authorized ("Instagram Consent"), generated photos remain strictly confidential and private. HD files are kept on our servers for a limited period (maximum 1 month) for downloading before being permanently deleted.
